FLOWCHART III: Crown Chooses to Seek an Adult Sentence

The youth is charged with a crime for which an adult is liable to over two years.

They have their first appearance in court.

The crown gives notice to seek an adult sentence.

If the youth gives notice not to oppose an adult sentence, he/she may go to trial, be found guilty, and given an adult sentence.

OR:

The case goes to plea, election and trial. Youth is found guilty.

Then the crown either:

• Applies for an adult sentence;
  If the youth does not give notice to oppose it, he is sentenced as an adult.
  Or there is a hearing to decide youth or adult sentence, and the youth may receive either one.

• Does not apply for an adult sentenced and the accused is sentenced as a youth
