The youth is charged with a crime for which an adult is liable to over two years, they have their first appearance in court, and are charged for a Presumptive Offence "a" (i.e. homicide, attempted murder, aggravated sexual assault).
A plea, election and trial will take place. If the youth is found guilty the following scenarios could take place:
At any time the crown can give notice they will not seek an adult sentence, find the youth guilty, and deliver a youth sentence.
At any time prior to sentence the youth may apply for a youth sentence. The crown may oppose, or give notice that a youth sentence is not opposed. The youth may be found guilty and receive a youth sentence.
