Flowchart I: Case Process
If police have reasonable and probable grounds to believe a youth has broken the law the following scenarios can happen:
- Police take no further action
- Police warning or caution
- Police referral to a program
- The youth is charged and released
- The youth is charged and detained
If the youth is charged and released they will be screened by the crown and either:
- Referred to the extrajudicial sanction program, and complete the program.
- If the program is not completed they will be sent to youth justice court
or:
- sent to youth justice court and found 'not guilty'
- sent to youth justice court, found 'guilty', and - with or without a pre-sentence report - sentenced
- sent to youth justice court and appeal the sentence
- sent to youth justice court and notified that the court will be seeking an adult sentence
If the youth is charged and detained they will receive a bail hearing and be released or detained; and then may:
or be screened by the crown and:
- sent to youth justice court and found 'not guilty'
- sent to youth justice court, found 'guilty', and - with or without a pre-sentence report - sentenced
- sent to youth justice court and appeal the sentence
- sent to youth justice court and notified that the court will be seeking an adult sentence
